Terms of Service

1. Agreement to Terms

By accessing My Warwick (mywarwick.com.au), submitting a listing, claiming a listing, or purchasing a Featured subscription, you agree to these Terms of Service. If you do not agree, you must not use the site.

2. About Us and the Network

My Warwick is operated by Shadowtek Pty Ltd (ACN 627 829 878) as Trustee for The Dey Family Trust (ABN 32 913 781 386), and is part of the MY Directory Network. The network's Master Terms apply across all network sites; where these site Terms and the Master Terms differ on a matter specific to this site, these site Terms prevail.

3. Directory Content and Unclaimed Listings

To provide a comprehensive local guide, My Warwick includes listings compiled from publicly available sources, including business websites and Google's business data services. These listings display information such as business name, address, phone number, website, opening hours, review ratings and photographs as published by those sources.

We do not warrant the accuracy of information sourced from third parties. If you own or represent a listed business you may, at no cost:

• Claim the listing to correct or manage its details, photos and hours
• Unlink incorrect data where a listing has been matched to the wrong business record
• Request removal of the listing entirely by emailing listings@mydirectory.network or replying to any email from us. Removal requests are actioned promptly.

4. Listing Tiers, Payments and Cancellation

My Warwick offers two listing tiers:

• Free listing — standard placement in the directory at no cost
• Featured listing — $5 AUD per month, or $49 AUD per year, billed via Stripe. Includes priority placement, Featured badge, logo, website link, photo gallery, and Special Offer and event fields

You may cancel a Featured subscription at any time through the billing portal linked from your manage page. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time. On cancellation or non-payment the listing reverts to the free tier and Featured benefits are removed.

We may modify pricing with 30 days' notice to active subscribers.

5. Founding Member Offer

Where offered, the Founding Member program provides a Featured listing at no charge for 12 months in exchange for displaying a My Warwick badge that links to this directory on the business's own website. The following conditions apply:

• The offer is limited in number per city and available once per business, at our discretion
• The badge must remain displayed for the duration of the complimentary period; we may end the complimentary Featured status if it is removed
• At the end of the 12 months the listing reverts to the free tier unless a paid subscription is started. We will remind you before this happens; nothing converts to a paid charge automatically
• The complimentary period has no cash value and cannot be transferred

6. Photos and Galleries

Listing photos may be sourced from the business's public Google Business Profile or uploaded by the listing owner. Featured listings may include a photo gallery refreshed periodically from the business's public profile. Listing owners can replace the header photo at any time from their manage page, and may request removal of any sourced image by contacting us. If you believe an image on this site infringes your rights, email listings@mydirectory.network and we will review and act promptly.

7. Submissions and Conduct

By submitting or claiming a listing you confirm that:

• You are authorised to represent the business listed
• All information provided is accurate and not misleading, including any service-area designation
• The listing does not contain illegal, defamatory, or infringing content
• The business genuinely operates in or services the Warwick QLD region

We may remove or reject any listing, claim, or content at our discretion without notice.

8. Communications

We send transactional emails related to your listing (confirmation, manage links, billing and renewal notices). We may also contact listed businesses about their own listing using contact details the business has published, consistent with applicable law including the Spam Act 2003 (Cth). Every such email identifies us and includes a working way to opt out; opt-out and removal requests are honoured promptly.

9. Advertising and Sponsorship

My Warwick may display promotional banners for our own brands and for paying local sponsors. Sponsor placements are marked as advertising where appropriate. Featured listing pages do not display third-party promotional banners.

10. Intellectual Property

You retain ownership of content you submit. By submitting, you grant Shadowtek Pty Ltd a non-exclusive, royalty-free licence to display that content on mywarwick.com.au, on the MY Directory Network hub, and in associated promotional material for the directory.

The My Warwick site design, code, and structure are owned by Shadowtek Pty Ltd and may not be copied or redistributed without written permission.

11. Warranties and Disclaimers

My Warwick is provided "as is". We make no warranties that the directory will be error-free or uninterrupted, that listing information (including third-party sourced information) is accurate, or that a listing will generate any particular business result. We are not a party to, and accept no responsibility for, dealings between site visitors and listed businesses.

12. Limitation of Liability

To the maximum extent permitted by law, Shadowtek Pty Ltd's total liability arising from your use of My Warwick shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for any indirect, consequential, or incidental damages.

Nothing in these Terms excludes rights or guarantees that cannot be lawfully excluded under the Australian Consumer Law or other applicable consumer protection law.

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.

14. Changes to These Terms

We may update these Terms at any time. The "Last Updated" date will reflect changes. Continued use of My Warwick after changes are posted constitutes acceptance.
