Terms of Service

1. Agreement to Terms

By accessing My Warwick (mywarwick.com.au) or submitting a business listing, you agree to be bound by these Terms of Service. If you do not agree, you must not use the site or submit a listing.

2. About Us

My Warwick is operated by Shadowtek Pty Ltd (ACN 627 829 878) as Trustee for The Dey Family Trust (ABN 32 913 781 386).

3. Directory Listings

My Warwick offers two listing tiers:

• Free listing — basic placement in the directory at no cost
• Featured listing — $5 AUD/month billed via Stripe, includes priority placement, featured badge, logo, website link, and special offer field

By submitting a listing you confirm that:

• You are authorised to represent the business listed
• All information provided is accurate and not misleading
• The listing does not contain illegal, defamatory, or infringing content
• The business genuinely operates in or serves the Warwick QLD region

We reserve the right to remove or reject any listing at our discretion without notice.

4. Featured Listing Payments & Cancellation

Featured listing subscriptions are billed monthly at $5 AUD/month via Stripe. All prices are in Australian Dollars.

You may cancel your Featured subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused days.

Upon cancellation, your listing reverts to the free tier and Featured benefits (priority placement, badge, logo, website link, special offer) are removed.

We reserve the right to modify pricing with 30 days' notice to active subscribers.

5. Advertising

My Warwick displays third-party advertisements via Google AdSense. We are not responsible for the content of these advertisements. Ads may appear on free listing pages; Featured listings do not display ads.

6. Intellectual Property

You retain ownership of all content you submit (business name, description, logo, etc.). By submitting, you grant Shadowtek Pty Ltd a non-exclusive, royalty-free licence to display that content on mywarwick.com.au and in associated promotional materials.

The My Warwick site design, code, and structure are owned by Shadowtek Pty Ltd and may not be copied or redistributed without written permission.

7. Warranties & Disclaimers

My Warwick is provided "as is". We make no warranties that the directory will be error-free or uninterrupted, or that a listing will generate any particular business result.

We are not responsible for the accuracy of listings submitted by third parties, or for any transactions or interactions between users and listed businesses.

8. Limitation of Liability

To the maximum extent permitted by law, Shadowtek Pty Ltd's total liability arising from your use of My Warwick shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for any indirect, consequential, or incidental damages.

Nothing in these Terms excludes rights or guarantees that cannot be lawfully excluded under the Australian Consumer Law.

9. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.

10. Changes to These Terms

We may update these Terms at any time. The "Last Updated" date will reflect changes. Continued use of My Warwick after changes are posted constitutes acceptance.
